do they physically prevent you from leaving?

hi, i've read a lot about the cult after watching Going Clear, and i'm completely fascinated by it. It's astonishing Miscavige hasn't been arrested and charged with running a massive criminal organization. I've read numerous accounts of people being guarded around the clock, seen how they have barbed fences pointing to the inside at the Gold Base in CA, being locked in the hole, etc., and their escapes.

So my question is how do they avoid getting charged with kidnapping? If someone says, "I want to leave," do they let them? Is the guarding and locked rooms largely a psychological (albeit very effective) tactic to make people think they cannot leave?
